Breaking into Broadcasting Classifieds (the “Service”) is provided to you (“User”) under the terms and conditions listed on this website. These terms and conditions include any amendments made now or in the future as well as any further rules or policies that may be posted on the website.

BY POSTING ANY CLASSIFIED AD, YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS

II. MODIFICATIONS TO SERVICE
Breaking into Broadcasting Classifieds reserves the right to modify or discontinue either temporarily or permanently, the Service with or without notice to User. User agrees that Breaking into Broadcasting Classifieds shall not be liable to User or any third-party for any modification or discontinuation of the Service.

III. CONDUCT
User agrees to abide by all laws and regulations in User’s use of the Service. User agrees to be solely responsible for the contents of User’s advertisements through the Service.

IV. TERMINATION
User agrees that Breaking into Broadcasting Classifieds may terminate User’s account or use of the Service if Breaking into Broadcasting Classifieds believes that (a) User has violated or acted inconsistently with this agreement, or that (b) User has violated the rights of Breaking into Broadcasting Classifieds or other Users.
User acknowledges and agrees that any termination of service under this Agreement and under any provision of this Agreement may be effected without prior notice (only in extreme cases). User also acknowledges and agrees that Breaking into Broadcasting Classifieds may immediately delete any ads associated with the User’s account.

V. DISCLAIMER, IDEMNITY AND WARRANTIES

BREAKING INTO BROADCASTING CLASSIFIEDS DISCLAIMS ANY WARRANTIES EXPRESSED OR IMPLIED ON GOODS OR SERVICES LISTED ON THE SERVICE. SELLERS ASSUME ALL THE RISK OR LIABILITY THAT ARISES FROM THEIR OFFER FOR SALE OF ANY ITEM.

BREAKING INTO BROADCASTING CLASSIFIEDS IS NOT LIABLE FOR THE ACCURACY OF THE INFORMATION CONTAINED IN THE SERVICE, OR THE CONTENTS OF ANY ADVERTISEMENTS, OR FOR THE CLAIMS OR OMISSIONS THEREIN. THE SERVICE SHALL NOT BE LIABLE FOR ANY THIRD-PARTY CLAIMS OR LOSSES OF ANY NATURE, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, PUNITIVE OR CONSEQUENTIAL DAMAGES.

BREAKING INTO BROADCASTING CLASSIFIEDS MAKES NO WARRANTY THAT THE SERVICE WILL MEET USER’S REQUIREMENTS, THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES BREAKING INTO BROADCASTING CLASSIFIEDS MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE, OR THAT DEFECTS IN THE BREAKING INTO BROADCASTING CLASSIFIEDS SERVICE OR SOFTWARE WILL BE CORRECTED.

USER AGREES TO IDEMNIFY AND HOLD BREAKING INTO BROADCASTING CLASSIFIEDS, FROM ANY CLAIMS, INCLUDING ATTORNEYS’ FEES, MADE BY ANY THIRD PARTY, DUE TO OR ARISING OUT OF USE OF THE SERVICE, USER’S CONNECTION TO THE SERVICE, OR USER’S VIOLATION OF THIS AGREEMENT.

THIS AGREEMENT SETS FORTH THE ENTIRE AGREEMENT BETWEEN BREAKING INTO BROADCASTING CLASSIFIEDS AND USER WITH RESPECT TO THE SUBJECT MATTER HEREOF AND SUPERCEDES ALL PREVIOUS REPRESENTATIONS, UNDERSTANDINGS OR AGREEMENTS AND SHALL PREVAIL NOTWITHSTANDING ANY VARIANCE WITH TERMS AND CONDITIONS OF ANY OTHER PRIOR WRITING BETWEEN THE PARTIES. IF ANY PROVISION OF THIS AGREEMENT IS HELD TO BE INVALID OR DEEMED UNENFORCEABLE BY A COURT OF COMPETENT JURISDICTION, THEN THE REMAINING PROVISION SHALL NEVERTHELESS CONTINUE IN FULL FORCE AND EFFECT. CUSTOMER MAY NOT TRANSFER OR ASSIGN THIS AGREEMENT WITHOUT PRIOR WRITTEN CONSENT OF BREAKING INTO BROADCASTING CLASSIFIEDS.

THIS AGREEMENT SHALL BE GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND RESPECTIVE INTERNATIONAL LAWS AND ALL CLAIMS CONCERNING THIS AGREEMENT SHALL BE BROUGHT EXCLUSIVELY IN THE STATE OR FEDERAL COURTS OF THE UNITED STATES OF AMERICA. BY THEIR USE OF THIS WEBSITE, THE PARTIES HEREBY CONSENT TO SUBMIT TO THE JURISDICTION OF SUCH COURTS AND WAIVE ANY PERSONAL JURISDICTION OR ALTERNATIVE VENUE DEFENSES CONCERNING THE SAID CLAIMS.

User Agreement

BY ACTIVATING AN ACCOUNT WITH BREAKING INTO BROADCASTING B-ROLL, YOU ARE CONCLUDING A LEGALLY BINDING AGREEMENT

This agreement was written in American (US) English. In the event and to the extent any translated version of this agreement conflicts with the American (US) English version, the American (US) English version controls.

Statement of Rights and Responsibilities

This Statement of Rights and Responsibilities (Statement) derives from the Breaking into Broadcasting B-Roll Principles, and governs our relationship with users and others who interact with Breaking into Broadcasting B-Roll. By using or accessing Breaking into Broadcasting B-Roll, you agree to this Statement.

Privacy

Your privacy is important to us. We designed our Privacy Policy to make important disclosures about how you can use Breaking into Broadcasting B-Roll to share with others and how we collect and can use your content and information.  We encourage you to carefully review your privacy settings in the account section of Breaking into Broadcasting B-Roll, and to use it to help make informed decisions.

Sharing Your Content and Information

You own all of the content and information you post on Breaking into Broadcasting B-Roll, and you can control how it is shared through your privacy and application settings. In addition:

Safety

We do our best to keep Breaking into Broadcasting B-Roll a professional, safe environment, but we cannot guarantee it. We need your help to do that, which includes the following commitments:

You will not send or otherwise post unauthorized commercial communications (such as spam) on Breaking into Broadcasting B-Roll.
You will not collect users’ content or information, or otherwise access Breaking into Broadcasting B-Roll, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission.

Registration and Account Security

Breaking into Broadcasting B-Roll asks that users provide their real names and information. Here are some commitments you make to us relating to registering and maintaining the security of your account:

You will not provide any false personal information on Breaking into Broadcasting B-Roll or create an account for anyone other than yourself without permission.
You will not create more than one personal profile.
If we disable your account, you will not create another one without our permission.
You will not use your personal profile for your own commercial gain (such as selling your status update to an advertiser).
You will not use Breaking into Broadcasting B-Roll if you are under 13.
You will not use Breaking into Broadcasting B-Rollf you are a convicted sex offender.
You will keep your contact information accurate and up-to-date.
You will not share your password, (or in the case of developers, your secret key), let anyone else access your account, or do anything else that might jeopardize the security of your account.
You will not transfer your account (including any page or application you administer) to anyone without first getting our written permission.
If you select a username for your account we reserve the right to remove or reclaim it if we believe appropriate (such as when a trademark owner complains about a username that does not closely relate to a user’s actual name).

Protecting Other People’s Rights

We respect other people’s rights, and expect you to do the same.

You will not post content or take any action on Breaking into Broadcasting B-Roll that infringes or violates someone else’s rights or otherwise violates the law.
We can remove any content or information you post on Breaking into Broadcasting B-Roll if we believe that it violates this Statement.
If we remove your content for infringing someone else’s copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal by contacting info@breakingintobroadcasting.com.
If you repeatedly infringe other people’s intellectual property rights, we will disable your account when appropriate.
If you collect information from users, you will: obtain their consent, make it clear you (and not Breaking into Broadcasting B-Roll) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it.
You will not post anyone’s identification documents or sensitive financial information on Breaking into Broadcasting B-Roll.

Termination

If you violate the letter or spirit of this Statement, or otherwise create risk or possible legal exposure for us, we can stop providing all or part of Breaking into Broadcasting B-Roll to you at any time without notice.

Please note, administrator reserves the right to moderate any comments deemed harmful, unlawful, misleading, malicious, or discriminatory. Should any users be recognized by administrator as a repeat offender of these prior listed acts, administrator reserves the right to terminate user’s account without notice, and user shall have no recourse.

You may also delete your account or disable your application at any time. In all such cases, this Statement shall terminate.

Disputes

You will resolve any claim, cause of action or dispute (claim) you have with us arising out of or relating to this Statement or Breaking into Broadcasting B-Roll exclusively in a state or federal court located in Atlanta, GA. The laws of the State of Georgia will govern this Statement, as well as any claim that might arise between you and us, without regard to conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Fulton County, Georgia for the purpose of litigating all such claims.
If anyone brings a claim against us related to your actions, content or information on Breaking into Broadcasting B-Roll, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.

Indemnity

As a user of this forum, the comments and information you post to this site are yours and yours alone. Breaking into Broadcasting does not endorse or stand representative of any the comments, tips, or advice offered by its users and subscribers.

By subscribing and activating an account with Breaking into Broadcasting B-Roll, you agree fully to indemnify and hold harmless Breaking into Broadcasting, and Geoscope LLC (Indemnities) and their successors and assigns, from any claim, action, liability, loss, damage or suit, arising from any comments posted to this site.

In the event of any asserted claim, the Indemnities shall provide the user reasonably timely written notice of same, and thereafter the user shall at its own expense defend, protect and hold harmless Indemnities against said claim or any loss or liability arising thereunder.

In the further event the user shall fail to so defend and/or indemnify and save harmless, then in such instance the Indemnities shall have full rights to defend, pay or settle said claim on their behalf without notice to undersigned and with full rights to recourse against the user or all fees, costs, expenses and payments made or agreed to be paid to discharge said claim.

Upon default, the user further agree to pay all reasonable attorney’s fees necessary to enforce this agreement.

This agreement shall be unlimited as to amount or duration.

WE TRY TO KEEP BREAKING INTO BROADCASTING B-ROLL UP, BUG-FREE, AND SAFE, BUT YOU USE IT AT YOUR OWN RISK. WE ARE PROVIDING BREAKING INTO BROADCASTING B-ROLL UP AS IS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT BREAKING INTO BROADCASTING B-ROLL WILL BE SAFE OR SECURE. BREAKING INTO BROADCASTING B-ROLL IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND YOU RELEASE US AND OUR PARENT COMPANY GEOSCOPE LLC FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES. IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE §1542, WHICH SAYS: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH CASES, BREAKING INTO BROADCASTING B-ROLL LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

Special Provisions Applicable to Users Outside the United States

We strive to create a global community with consistent standards for everyone, but we also strive to respect local laws. The following provisions apply to users outside the United States:

You consent to having your personal data transferred to and processed in the United States.
If you are located in a country embargoed by the United States, or are on the U.S. Treasury Department’s list of Specially Designated Nationals you will not engage in commercial activities on Breaking into Broadcasting, Breaking into Broadcasting B-Roll, or our parent company Geoscope LLC (such as advertising or payments) or operate a Platform application or website.

Definitions

By Breaking into Broadcasting B-Roll we mean the features and services we make available, including through (a) our website at www.breakingintobroadcasting.com and any other Breaking into Broadcasting or Geoscope LLC branded or co-branded websites (including sub-domains, international versions, widgets, and mobile versions); (b) our Platform; (c) other media, software (such as a toolbar), devices, or networks now existing or later developed.
By Administrator we mean anyone with administrative capabilities assigned to the Breaking into Broadcasting project, or the principle of Geoscope LLC>
By Platform we mean a set of APIs and services that enable others, including application developers and website operators, to retrieve data from Breaking into Broadcasting B-Roll or provide data to us.
By information we mean facts and other information about you, including actions you take.
By content we mean anything you post on Breaking into Broadcasting B-Roll that would not be included in the definition of information.

By application we mean any application or website that uses or accesses Platform, as well as anything else that receives or has received data from us.  If you no longer access Platform but have not deleted all data from us, the term application will apply until you delete the data.

Other

If you are a resident of or have your principal place of business in the US or Canada, this Statement is an agreement between you and Breaking into Broadcasting, a subsidiary of Geoscope LLC.  References to “us,” “we,” and “our” mean either Breaking into Broadcasting B-Roll, Breaking into Broadcasting, or Geoscope LLC.
This Statement makes up the entire agreement between the parties regarding Breaking into Broadcasting B-Roll, and supersedes any prior agreements.
If any portion of this Statement is found to be unenforceable, the remaining portion will remain in full force and effect.
If we fail to enforce any of this Statement, it will not be considered a waiver.
Any amendment to or waiver of this Statement must be made in writing and signed by us.
You will not transfer any of your rights or obligations under this Statement to anyone else without our consent.
All of our rights and obligations under this Statement are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.
Nothing in this Statement shall prevent us from complying with the law.
This Statement does not confer any third party beneficiary rights.
